Terms and Conditions (as of 26th Nov, 2024) 1. Introduction These Terms and Conditions ("Agreement") govern the provision of caricature artist services ("Services") by Tom Faraci ("Artist") of The American Caricature Company (“Business”) to the client ("Client") for the event ("Event") specified in the booking confirmation. 2. Booking and Payment Booking Confirmation: A booking is confirmed upon payment of a non-refundable deposit of 50% of the total fee. Payment Terms: The remaining balance is due on or before the date of the Event. Payments can be made via invoice, bank transfer, or credit card on site. Cancellation Policy: Cancellations made before the Event will not be subject to payment of the remaining balance, however the deposit will not be refunded. Cancellations made within 48 hours of the Event will be charged the full fee. 3. Services Provided Scope of Services: The Artist will provide caricature drawings for guests at the Event for the agreed up duration, on the agreed upon date and time. Materials: The Artist will supply all necessary materials for the caricature drawings, including paper, drawing tools, and protective sleeves (or similar) for the finished artwork. Drawings will be in black and white and shaded in grayscale at the Artist’s discretion. Colour is an option, but will double the drawing time (see 5. Artist's Rights and Responsibilities: Performance) and therefore less subjects will be drawn. Guests will be asked to form a queue and will be drawn on a first-come, first-serve basis. Guests who leave the queue and return must enter at the back of the queue, as it cannot be assumed their spot will be saved. The Artist cannot be expected to manage the queue, as they will be focused on the drawings at hand. Any queue disputes must be resolved by the guests themselves or by the Client. In fairness to everyone, drawings will only be done of guests in attendance. No drawings from photos will be permitted. Being in the queue does not guarantee a drawing. Ahead of the scheduled end time, they will make an effort to communicate this in advance and cut off the queue. Alternatively, the Client may request an extension of Services charged at the agreed upon hourly rate. (see 4. Client Responsibilities: Extension of Services) 4. Client Responsibilities Event Details: The Client must provide accurate details about the Event, including date, time, location, and expected number of guests. Permissions: The Client is responsible for obtaining any necessary permissions or permits for the Artist to perform at the Event. Setup Requirements: The Client must provide a suitable space for the Artist to work: If indoors: The Client is responsible for arranging a suitable location with decent lighting. If that cannot be arranged, then a location near an outlet will suffice so that the Artist may provide their own lights. If outdoors: The Client is responsible for arranging a suitable location with sufficient shade/shelter from weather. The Client shall provide, if able, three chairs (one for the Artist and two for guests). If the Client cannot provide chairs, please communicate this to the Artist ahead of the Event so they may plan to provide their own. A table may be requested if available, but is not essential to the Artist’s setup. Extension of Services: Should the client decide to extend the Artist’s drawing time, they may do so at the agreed upon hourly rate. Extended time may be paid by cash or card on site or the Client may be billed after the Event. 5. Artist's Rights and Responsibilities Performance: The Artist will perform to the best of their ability and provide high-quality caricature drawings. Each subject takes approximately 3-5 minutes to draw a face, averaging about 15 faces per hour. This refers to individual subjects, not number of drawings. For example, If the Artist is drawing all couples, two faces to a page, 12 subjects would be across 6 drawings. Breaks: The Artist is entitled to a 5-10 minute break every 2 hours. Photos and video recording: The Artist will seek verbal confirmation of consent before taking photos or video recordings of any guests. (See 6. Intellectual Property: Usage Rights) Liability: The Artist is not liable for any damages or injuries that occur during the Event, except in cases of gross negligence or willful misconduct. 6. Intellectual Property Copyright: The Artist retains the copyright to all caricature drawings created during the Event. The Client may use the drawings for personal, non-commercial purposes. Usage Rights: The Artist may use images of the caricature drawings for promotional purposes, unless the Client requests otherwise in writing. 7. Miscellaneous Governing Law: This Agreement shall be governed by and construed in accordance with the laws of England and Wales. Amendments: Any amendments to this Agreement must be made in writing and signed by both parties. Severability: If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect. 8. Acceptance By submitting payment of the deposit, the Client agrees to the terms and conditions outlined in this Agreement.
